Terms of Service

1. Introduction

Welcome to OB Event Charter LLC ("Company," "Oyster Bay Event Charter," "we," "our," "us"). These Terms of Service ("Terms") govern your use of our boat charter services ("Services"). By booking or using our Services, you agree to be bound by these Terms.

If you do not agree with any part of these Terms, please do not use our Services.

2. Eligibility

You must be at least 18 years old to book a charter with us. By booking, you represent and warrant that you meet all eligibility requirements.

3. Bookings and Payments

  • Reservation: A reservation is confirmed once a deposit/payment is received.

  • Payments: Full payment must be made by the date of your charter.

  • Cancellations:

  • Customer cancellations made 7 days prior to the charter date will receive a full refund.

  • Cancellations within 6 days of the charter date may result in no refund.

  • We reserve the right to cancel for safety or weather reasons, with a full refund or option to reschedule.

4. Safety and Conduct

  • Passenger Responsibility: You and your guests must act responsibly and follow all safety instructions.

  • Prohibited Items: Illegal drugs, weapons, and any hazardous materials are strictly prohibited on board.

5. SMS Messaging Terms

OB Event Charter LLC operates an SMS text messaging program for customers who opt in to receive messages. The following terms apply to all SMS communications from us.

Program Description. Our SMS program sends booking confirmations, appointment reminders, trip preparation details, rebooking communications, and (with separate consent) promotional offers, available charter dates, and seasonal updates. Customers may consent to transactional messages, marketing messages, or both.

How to Opt In. You may opt in by submitting your mobile phone number through the booking inquiry form on https://www.oysterbayeventcharter.com and checking the applicable SMS consent box(es). Both consent checkboxes are unchecked by default and are entirely optional. You may submit the booking form without consenting to SMS communications.

How to Opt Out. You may opt out of receiving SMS messages from OB Event Charter LLC at any time by replying STOP to any text message you receive from us. After replying STOP, you will receive one final confirmation message and will no longer receive SMS communications from this program. You may opt back in at any time by replying START.

For Help. Reply HELP to any SMS message for assistance, or contact us directly at info@oysterbayeventcharter.com.

Message Frequency. Message frequency varies based on your booking activity, typically 2–8 messages per month.

Message and Data Rates. Message and data rates may apply. OB Event Charter LLC does not charge for SMS messages, but standard message and data rates from your wireless carrier may apply to each message sent or received. Please consult your mobile service plan for details.

Carrier Liability. Wireless carriers are not liable for delayed or undelivered messages. OB Event Charter LLC is not responsible for delays, failures, or errors in message delivery caused by your wireless carrier, mobile network conditions, or other third-party service providers. Supported carriers include AT&T, Verizon, T-Mobile, and other major U.S. wireless carriers, but availability is not guaranteed on every carrier or in every location.

Age Requirement. You must be at least 18 years old to opt in to SMS communications from OB Event Charter LLC.

Privacy. Information collected through our SMS program is handled in accordance with our Privacy Policy, available at https://www.oysterbayeventcharter.com/privacy-policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

6. Weather Policy

Charters may be canceled or rescheduled at the captain's discretion if conditions are unsafe (e.g., storms, high winds). Safety is our top priority.

7. Assumption of Risk

Chartering a boat involves inherent risks. By booking with OB Event Charter LLC, you assume all risks associated with boating, including personal injury, illness, or property damage.

8. Limitation of Liability

OB Event Charter LLC is not liable for:

  • Any injuries, damages, or losses arising from participation in the charter.

  • Weather-related delays or cancellations.

  • Personal belongings lost, damaged, or stolen during the charter.

9. Indemnification

You agree to indemnify and hold harmless OB Event Charter LLC, its employees, contractors, and affiliates from any claims, damages, losses, or expenses arising from your use of our Services.

10. Photo and Video Release

Unless you notify us otherwise in writing, you grant permission for photos and videos taken during your charter to be used for promotional purposes (website, social media, advertisements, etc.).

11. Governing Law

These Terms are governed by the laws of the State of New York, without regard to its conflict of law principles.

12. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be effective upon posting to our website or notifying you directly.
